Copyright & Takedown

MyCarts respects the intellectual property of others. This page explains how rights-holders can report allegedly infringing content and how we respond. It implements our obligations under the EU Digital Services Act (DSA), the UK Online Safety Act, and the US Digital Millennium Copyright Act (DMCA).

1. What we host

MyCarts users create wishlists made up of titles, descriptions, prices, product URLs pointing to third-party retailers, and uploaded or auto-fetched images. We don't sell goods, we don't hold inventory, and we don't set product prices.

Most product images shown on a card are either (a) fetched once from a retailer's public Open Graph metadata, (b) uploaded by the user, or (c) replaced by one of our own generic fallback illustrations when no image is available.

2. Submitting a takedown notice

If you are the rights-holder (or their authorised agent) for material that appears on MyCarts and you believe it's being used without permission, email us a notice that includes:

  • Your full legal name, postal address, phone, and email.
  • A description of the copyrighted work (or trademark / personality right) you claim has been infringed.
  • The exact URL on MyCarts where the material appears (e.g. https://mycarts.app/share/<slug> or a screenshot of the specific item card).
  • A statement that you have a good-faith belief that the use is not authorised by the rights-holder, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorised to act on behalf of the rights-holder.
  • Your physical or electronic signature.

3. What happens next

We aim to acknowledge valid notices within 2 business days and to remove or disable access to the reported content within 7 days if the notice is complete. We will notify the user who posted the content and tell them why.

We may keep a redacted record of the notice in our internal audit log for legal compliance. Repeat infringers may have their account suspended or terminated under our Terms of Service.

4. Counter-notice

If you posted content that was removed and you believe the removal was a mistake or misidentification, you can submit a counter-notice. It must contain:

  • Your full name, postal address, phone, and email.
  • Identification of the removed content and where it appeared before removal.
  • A statement under penalty of perjury that you have a good-faith belief the content was removed by mistake or misidentification.
  • Your consent to the jurisdiction of a competent court (your local court if you're outside the US, or a US federal court if you're in the US) and your agreement to accept service of process from the original notice-submitter.
  • Your physical or electronic signature.

Send counter-notices to the same address. If we receive a valid counter-notice we will forward it to the original complainant and may restore the content after 10–14 business days unless they file a court action to keep it down.

5. Trademarks & personality rights

The same process applies to trademarks (passing-off / unfair competition) and to the right of publicity (image / likeness). Tell us which right is affected so we can route the notice correctly.

6. Bad-faith notices

Sending a knowingly false takedown notice can expose you to liability under §512(f) of the US DMCA and equivalent provisions in the UK and EU. We may share notices with the affected user and, where required, with the Lumen Database.
